Wayleaves
B4RN’s Wayleave agreement is a document that gives permission to install B4RN ducts across a landowner’s property. We are very grateful for these free wayleaves as it is the only way a network of B4RN’s scale can be built by the community.
Shares For Work
Landowners, tenant farmers, contractors etc. are eligible for shares for work for the distances of properly installed B4RN duct they install for a fixed £1.50 per metre. These are the people with professional groundwork skills and the capital investment in diggers, tractors, moleploughs etc. The work will have to be approved by the local B4PR champion, meet B4RN standards, be referenced by route number and chamber location, and be accompanied by a tax invoice. In summary:
• All routes, work and timing are only undertaken with landowner agreement.
• Details are agreed in principle first and then a Wayleave document is produced.
• B4RN provide all the ducting, fibre and access chambers.
• Ducting can be installed using low impact mole plough or trenching.
• B4RN will make every reasonable effort to return the ground to its original state after installation.
• The community model will only work if sufficient landowners agree to free access.
- B4RN agrees to take every care to minimise any inconvenience during the installation and also to make good any damage done.
- B4RN agrees that the landowner is not liable for any costs associated with subsequent accidental damage to the network across their land.
- The Landowner/tenant are asked to agree to let B4RN have future access to the land for the purpose of maintaining or repairing the network.
- B4RN will endeavour to arrange for any such access to be at mutually agreeable times and to minimise any disruption and damage to the land caused by the repair. Any accidental damage done will be made good by B4RN.
- The Landowner/tenant agree that if they wish to cancel the Wayleave agreement they will give B4RN at least 12 (twelve) months' notice to remove their network components from their land. This is necessary to give B4RN time to install new network runs and to avoid disrupting the service to other members of the community.
- B4RN is a not-for-profit community benefit society (registration no. 31352R) whose objective is to provide broadband services to rural communities. In recognition of this the Landowner are asked to agree to waive any payment for the granting of the wayleave.
